3. Booking Our Services

  • 3.1. Booking Requests: Bookings can be requested through our Website, by email, by phone, or in person (if applicable). A booking request does not guarantee a confirmed Booking.
  • 3.2. Required Information: To make a booking, you will need to provide necessary information, including but not limited to your full name, contact details (phone number, email address), the number of participants, and any specific requirements or preferences.
  • 3.3. Booking Confirmation: A Booking is only considered confirmed once SAFETOURS IKE has received full payment (or deposit, as specified) and has issued a written booking confirmation (usually via email). Please check your booking confirmation carefully and inform us immediately of any errors.
  • 3.4. Accuracy of Information: You are responsible for providing accurate and complete information at the time of booking. SAFETOURS IKE is not liable for any issues arising from incorrect information provided by you.
  • 3.5. Minimum Age: The person making the booking must be at least 18 years old. Participants under 18 must be accompanied by an adult responsible for them.

4. Prices and Payment

  • 4.1. Prices: All prices for our Services are quoted in Euros (EUR) and are inclusive of Value Added Tax (VAT) at the current applicable rate in Greece, unless otherwise stated.
  • 4.2. What’s Included: The price includes only those items explicitly listed in the Service description on our Website or in your booking confirmation. Any items not listed (e.g., transportation to/from the departure point, meals or drinks unless specified, personal expenses, gratuities) are not included.

5. Cancellations, Changes, and Refunds

  • 5.1. Cancellation by You (The Customer):

    • 5.1.1. How to Cancel: To cancel your Booking, you must notify us in writing (e.g., by email to [Insert Your Cancellation Email Address or info@safetours.gr]). The date of cancellation will be the date we receive your written notification.
    • 5.1.2. Cancellation Fees & Refunds: Our cancellation policy is as follows:
      • Cancellations made more than [e.g., 72 hours] before the scheduled departure time: [e.g., Full refund minus any non-refundable transaction fees OR 90% refund].
      • Cancellations made between [e.g., 72 hours and 48 hours] before the scheduled departure time: [e.g., 50% refund].

    • 5.1.3. Non-Applicability of EU Right of Withdrawal: Please note that for leisure activities to be provided on a specific date or period of performance, such as our boat tours and excursions, the statutory 14-day right of withdrawal (cooling-off period) under EU consumer protection law does not apply (as per Article 16(l) of Directive 2011/83/EU on consumer rights). Your right to cancel is governed solely by the terms stated in section 5.1.2.
    • 5.1.4. Changes by You: If you wish to change your booking (e.g., date, number of participants), please contact us as soon as possible. All changes are subject to availability and may incur an administration fee or price difference. We cannot guarantee that all requested changes can be accommodated.
  • 5.2. Cancellation or Changes by SAFETOURS IKE:

    • 5.2.1. Reasons for Cancellation/Change: We reserve the right to cancel or significantly alter a Service due to unforeseen circumstances. These may include, but are not limited to:
      • Unsafe weather conditions (e.g., high winds, storms, as determined by the captain or port authorities).
      • Insufficient number of participants for a scheduled tour to operate viably (if applicable, this will be stated in the tour description).
      • Technical problems with the boat or equipment.
      • Force Majeure events (see Section 9).
      • Instructions from port authorities or other official bodies.
    • 5.2.2. Options for You: If we cancel your Service before departure, we will offer you the choice of:
      • (a) A full refund of all monies paid for the cancelled Service; OR
      • (b) Rescheduling your Booking to an alternative date or Service of equivalent value, subject to availability. If the alternative is of lower value, we will refund the difference; if it is of higher value, you may be required to pay the difference.
    • 5.2.3. Our Liability: SAFETOURS IKE is not responsible for any incidental expenses you may have incurred as a result of your booking, such as visa fees, travel insurance, or non-refundable travel costs (e.g., flights, accommodation) in the event of a cancellation by us. We recommend you have adequate travel insurance.

6. Your Obligations and Conduct

  • 6.1. Arrival Time: You must arrive at the designated departure point at least [e.g., 15-30 minutes] before the scheduled departure time. Failure to arrive on time may be treated as a “no-show,” and no refund will be provided.
  • 6.2. Safety Instructions: You must listen to and follow all safety briefings and instructions given by our crew at all times. Life jackets and other safety equipment are provided and must be used as instructed.
  • 6.3. Health and Fitness: You confirm that you and all members of your party are fit to participate in the booked Service. Please inform us at the time of booking (or as soon as possible thereafter) of any medical conditions, disabilities, or dietary requirements that may affect your or others’ participation or safety. While we endeavor to accommodate special requirements, we cannot guarantee this in all cases and reserve the right to refuse participation if we believe it would be unsafe for you or others.
  • 6.4. Behavior: You are expected to behave in a respectful and considerate manner towards our crew, other customers, and the environment. SAFETOURS IKE reserves the right to refuse participation or remove any person(s) from a Service if their behavior is deemed to be disruptive, offensive, dangerous to themselves or others, or if they are under the influence of alcohol or drugs, without any right to a refund.
  • 6.5. Personal Belongings: You are responsible for your personal belongings. SAFETOURS IKE accepts no liability for loss, damage, or theft of personal items.
  • 6.6. Children: Children under 18 must be supervised by a parent or guardian at all times.

7. Our Obligations and Liability (SAFETOURS IKE)

  • 7.1. Provision of Services: We will provide the Services as described on our Website and in your booking confirmation, with reasonable care and skill, and in compliance with applicable Greek laws and safety standards.
  • 7.2. Safety: The safety of our customers and crew is our highest priority. Our boats are equipped with safety equipment as required by Greek maritime regulations, and our crew are trained in safety procedures.
  • 7.3. Changes to Itinerary: While we aim to follow the advertised itinerary, we reserve the right to make minor changes to the itinerary due to weather conditions, sea conditions, or other operational reasons, without prior notice and without liability, provided the overall quality and nature of the Service are not significantly affected.
  • 7.4. Limitation of Liability:
    • SAFETOURS IKE shall not be liable for any injury, death, loss, damage, accident, delay, or irregularity which may be occasioned either by reason of defect in any vessel or vehicle, or through the acts or defaults of any company or person engaged in conveying the passenger or in carrying out the arrangements of the tour.
    • Our liability to you is limited to the price you paid for the Service, except in cases of death or personal injury caused by our proven negligence.
    • We are not liable for any indirect or consequential loss (e.g., loss of enjoyment, loss of earnings).
  • 7.5. Insurance: SAFETOURS IKE maintains public liability insurance as required by Greek law. We strongly recommend that you arrange your own comprehensive travel insurance to cover cancellation, medical expenses, personal accident, personal belongings, and other potential risks.

8. Force Majeure

SAFETOURS IKE shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by a Force Majeure Event. A “Force Majeure Event” means any act or event beyond our reasonable control, including but not limited to acts of God, war, terrorism, fire, flood, natural disaster, severe weather conditions, strikes, pandemics, government restrictions or advisories, or failure of public utilities or transport networks. In such cases, we will endeavor to offer alternative arrangements or a refund, but this cannot be guaranteed.

9. Complaints

If you have a complaint during your Service, please bring it to the attention of our crew immediately so that we can try to resolve it on the spot. 14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Greece. You agree that the courts of Heraklion, Crete, Greece, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms (subject to any mandatory consumer protection laws that may grant jurisdiction to courts in your country of residence within the EU).

15. Online Dispute Resolution (ODR)

The European Commission provides an online platform for dispute resolution (ODR platform), which consumers can access at: https://ec.europa.eu/consumers/odr.
